1.Rent a car

BE CARS reserves the right to refuse a particular booking request for operational reasons, especially in the event of unavailability of vehicles as requested by the customer. It may also refuse or reject such a request or reservation if it is incomplete, incorrect, or if it does not comply with the applicable conditions of hire or with the regulations in force.

The credit card must belong to the cardholder providing it and must be valid and in force. Major credit cards (Visa / MC) are accepted, as well as bank debit cards issued by financial institutions. Prepaid cards are not accepted.

2. Rental requirements

BE CARS does not rent vehicles to drivers under 25 years of age, as informed during the booking process.

Users may only rent a vehicle with BE CARS when they confirm the following requirements to BE CARS:

  • Be at least 25 years old.
  • Have a valid driving licence valid in Spain*.
  • Have the valid licence mentioned in point b) above, at least two years old at the time of the rental requested in the reservation made by the user to BE CARS.

In accordance with the above, BE CARS does not apply a charge in case of booking requests made by users who do not comply with all the above requirements, as it will not be possible to attend any request from users who do not comply with all these requirements.

(*) Driving licences issued in accordance with Spanish legislation and those issued in countries of the European Union and the European Economic Area (Iceland, Liechtenstein and Norway) in accordance with the provisions of the applicable European regulations are valid for driving in Spain. In addition, under certain conditions, the following driving licences are also valid for driving in Spain:

  • Nationals of other countries which are issued in accordance with Annex 9 to the Geneva Convention, or Annex 6 to the Vienna Convention, or which differ from those models only in the adoption or deletion of non-essential headings.
  • Nationals of other countries that are written in Spanish or accompanied by an official translation of Spanish.
  • International permits issued abroad in accordance with Annex 10 of the Geneva Convention, or in accordance with the model of Annex E of the Paris International Convention, in the case of nations acceding to this Convention which have not signed or acceded to the Geneva Convention. In this case, the valid international permit shall be presented together with the national permit valid in the country concerned.
  • Those recognised in particular international conventions to which Spain is a party and under the conditions indicated therein.
  • BE CARS does not accept copies of permits.
  • In the event of loss or theft, no complaint will be valid

The same conditions and requirements also apply to any additional drivers that may be indicated by the customer.

BE CARS reserves the right to refuse or reject a particular request or reservation if these specific conditions are not met.

Similarly, after confirmation of the booking, BE CARS may cancel the booking in the following cases:

  • The information provided by the customer is found to be incorrect, not real or not up to date.
  • The customer breaches or breaches the terms of the contract

3. Conditions with respect to the vehicle:

The vehicle model booked is only indicative and may be replaced by another of similar characteristics within the same category contracted by the customer.

In the case of BE CARS fleet vehicles with GPS service, geolocation data may be accessed. The GPS service is a service that operates as a protection measure for our vehicles, their occupants or any other third party during the rental period that is applied by BE CARS with all the legally required guarantees in this area.

The vehicle may not leave the island where it is rented and must be used by the client on the basis of the following criteria:

  • Compliance with applicable national regulations.
  • Not to be used for illegal purposes or as a means of committing them.
  • Driving is allowed only on public and paved roads.
  • It must not be used for commercial or advertising purposes
  • The recommended fuel for the vehicle should be used.
  • Make sure that the vehicle is completely locked when parked.
  • Child seats and child seats (if requested) will be provided when the car is collected, and you must place them correctly in the car.
  • Make sure that luggage or surfboards are properly secured in the luggage racks if you have hired them.
  • If a malfunction or breakdown is observed, the vehicle must be stopped, parked correctly and safely (if possible) and BE CARS informed immediately.

The customer shall be responsible for the vehicle during the rental period, i.e. from the moment he/she picks up the vehicle until the moment he/she delivers it or returns it correctly to BE CARS. If the return is not carried out in the manner indicated by BE CARS, the customer’s responsibility for the rented vehicle shall extend until the time of registration by BE CARS of the actual and effective receipt of the vehicle.

4. Delivery and return of the vehicle:

The delivery and return of the rented vehicle will take place at the offices, dates and times specified in your reservation (confirmed by BE CARS).

Under no circumstances may the vehicle be returned to an island other than the one indicated in the rental contract.

If the office of return of a reservation is not the same as the office of collection of the vehicle, and the duration of the reservation is 3 days or less, an additional €10 will be charged.

The rented vehicle can only be collected during opening hours, but can be returned outside normal rental office hours at no extra charge, at the location agreed in the contract with BE CARS.

If your flight is delayed or cancelled, you must inform us in time so that we can offer you the best customer service in these cases. If you fail to do so, we cannot guarantee that your booking will be maintained, although BE CARS will endeavour to maintain it for as long as possible. For this reason, when it is no longer possible, BE CARS reserves the right to cancel your reservation and, therefore, to freely dispose of the reserved vehicle in such cases without any right to compensation or indemnity.

The vehicle must be returned in the same condition in which it was received, with the exception of normal wear and tear. Otherwise, the customer must provide documentation, reports or supporting documents regarding incidents or damage to the vehicle.

No amount will be refunded to the customer for early return of the vehicle.

The renter accepts that the rented vehicle does not have a boot lid to prevent the locks from being forced or the windows from being broken. In the event that the lessee insists on the installation of the boot lid, the lessee agrees to pay for all damage caused to the vehicle, leaving a deposit of 150€ which will be returned when the vehicle is returned in the same condition in which it was delivered.

Please ensure that no items of your property are left in the vehicle at the time of return. If this happens, BE CARS is not responsible for its loss.

5. Items included in your vehicle reservation price

The final price of the vehicle reservation includes the following items:

  1. Taxes (IGIC / VAT included).
  2. Unlimited mileage.
  3. Second driver free of charge.
  4. Airport service.
  5. Free cancellation up to 48 hours prior to booking
  6. Approved infant seats and booster cushions for children free of charge. It is important to note that according to the Spanish General Traffic Regulations: minors with a height of 135 cm or less must use an approved child restraint system.
  7. The following insurances (no excess / zero excess):
    • Collision Damage Waiver (CDW).
    • Theft protection (TP).
    • Personal Accident Insurance (PAI).
    • Damage to third parties (IT).

No amounts are required to cover the excess.

*For Luxury category vehicles, a valid credit card number in the name of the main driver will be required. We do not require pre-authorisation on the credit card.

6. Situations or contingencies not covered by the insurance policy

Our insurance does not cover the following situations or contingencies, so the tenant agrees to pay the costs incurred by:

  • Damage to tyres and wheels.
  • Loss or breakage of car keys.
  • Incorrect refuelling.
  • Clutch failure due to driver misuse.
  • Accidents related to reckless driving or driving under the influence of alcoholic beverages, drugs, narcotics or any other intoxicating or psychotropic substance.
  • Off-road driving.
  • Fines
  • Driving the vehicle by persons not authorised in the contract.
  • Loss or theft of accessories, tools, spare rubber, battery or documentation.
  • The repair costs incurred when, due to negligence on the part of the lessee, personal effects are left inside the vehicle.
  • The expenses for the transfer of the personnel of this Company to different points of the sila when, due to negligence of the lessor, the keys of the rented vehicle are lost or stolen or forgotten inside the vehicle.
  • The repair costs incurred when, due to negligence on the part of the lessee, personal effects are left inside the vehicle.

*For Luxury category vehicles, a valid credit card number in the name of the main driver will be required. We do not require pre-authorisation on the credit card

7. Accidents

In the event of an accident, the customer shall be obliged to:

  • Do not move the vehicle from the place of the accident until the Competent Authority has been summoned and the corresponding report has been drawn up.
  • To report the facts immediately to BE CARS.
  • Not to make any agreement with the other party about the accident.
  • Not to abandon the damaged vehicle without having taken the necessary measures.
  • The contracted cover will be cancelled if any of the aforementioned reasons arise.

8. Fuel policy

At BE CARS we do not do business with fuel. However, the vehicle must be returned by the customer with the same amount of fuel it was received with and the customer must pay the difference if that amount is less.

9. Modification of these General Conditions

These conditions may be modified by BE CARS at any time, particularly to adapt to regulatory changes or applicable commercial policy, and we therefore recommend that, before renting a vehicle through our platform, customers read these terms and conditions carefully.

10. Applicable law and jurisdiction

In the event of any dispute or discrepancy relating to any of these conditions, the parties waive any other jurisdiction that may apply and agree to submit to the Courts and Tribunals of Santa Cruz de Tenerife in accordance with the provisions of Spanish law that may apply in each case.
